I. Scope of Application
Hotel NordRaum, Hotel NordRaum GmbH (hereinafter referred to as the Hotel) rents to the guest the agreed hotel room with the agreed amenities for the agreed length of stay. These General Business and Booking Conditions (hereinafter referred to as the “Terms”) apply in addition to the provisions of the accommodation contract.
II. Conclusion of Contract
- By reserving a hotel room, the guest offers the Hotel the conclusion of an accommodation contract. Subject to availability, the guest receives a reservation confirmation from the Hotel, either in text form or verbally. The accommodation contract between the Hotel and the guest comes into effect upon receipt of the reservation confirmation (in writing or verbally).
- Offers from the Hotel to conclude an accommodation contract are subject to change and non-binding. The Hotel is entitled to decline booking requests as long as no accommodation contract has yet been concluded. Statutory prohibitions on discrimination remain unaffected.
- The guest has no claim to the provision of a specific hotel room. The guest is only entitled to the provision of a hotel room within the room category booked.
III. Cancellations and No-Shows
- The following terms “simple reservation” and “guaranteed reservation” differ in that, with a simple reservation, the guest merely orders a room, whereas with a guaranteed reservation, the guest additionally guarantees payment by providing their credit card number. The following term “cancellation” refers to the guest's withdrawal from the accommodation contract. The following term “no-show” refers to the guest simply failing to arrive on the arrival date without a verbal or written cancellation of the accommodation contract.
- A simple reservation automatically lapses (i.e. without notifying the guest) on the day of arrival at 6:00 pm, if the guest has not arrived by then or has not guaranteed the reservation by providing a credit card number. See also Section IV. 2. in this regard.
- The guest may cancel a guaranteed reservation free of charge until 2:00 pm on the day of arrival. For trade fair and event periods, the special conditions contained in Clause XVII. apply. Cancellations of guaranteed reservations made after 2:00 pm on the day of arrival are not permitted and do not result in termination of the accommodation contract. In this case, the guest remains obliged to pay the hotel the price for one night's accommodation. The same applies if the guest fails to arrive on the day of arrival without cancelling the reservation.
IV. Arrival and Departure
- The hotel provides the guest with the hotel room in the agreed room category and/or fittings on the day of arrival, subject to availability, generally from 2:00 pm, but in no case later than 3:00 pm. Upon arrival at the hotel, the guest receives the room number and the key card for the hotel room after completing the registration form. If the reception is closed, the key can be issued via the check-in machine provided for this purpose. For this, the guest is informed of a code before arrival, which must be entered at the check-in machine.
- In the case of a simple reservation, arrival must take place on the arrival date by 6:00 pm at the latest. Otherwise, the Hotel is entitled to rent the hotel room reserved for the guest to another party, without the guest being able to derive any claims whatsoever against the Hotel as a result.
- On the departure date, the guest must vacate the hotel room and return it to the Hotel undamaged by 11:00 am at the latest.
If the guest returns the hotel room to the Hotel in breach of contract only after 11:00 am on the departure date, the guest owes the Hotel liquidated damages in the amount of 100% of the price for one night's stay for the hotel room. The guest is permitted to prove that no damage or loss in value was incurred by the Hotel as a result of the late return of the hotel room, or that any such damage or loss was substantially lower than the aforementioned lump-sum damages.
V. Pets
Bringing pets requires the Hotel's consent. The guest is obligated to notify the Hotel in advance of the wish to bring one or more pets. If the Hotel consents to the bringing of pets, this is subject to the condition that the pets remain under the guest's constant supervision, are free of disease, and otherwise pose no danger to hotel staff or other hotel guests. A fee is charged per pet and per night, the amount of which the Hotel will communicate to the guest upon request, at the latest upon conclusion of the accommodation contract.
- Pets may not be brought into the breakfast room.
- Dogs must be kept on a leash within the Hotel.
- Animals may not be left alone in the room if this poses a risk of damage or disturbance.
- The guest is liable under statutory provisions for any damage caused by the animal.
- Assistance dogs are treated in accordance with statutory requirements.
VI. Terms of Use
- Only the persons named in the accommodation contract are entitled to use the hotel room.
- The guest must treat the hotel room with care and consideration.
- The guest must show consideration for other hotel guests and observe the house rules, which are posted in the Hotel and form part of the accommodation contract.
- The guest is not permitted to cook food brought from outside in the hotel room or anywhere else on the hotel premises.
- Children under 14 years of age must be supervised by an adult guest at all times during their stay at the Hotel.
- The guest is strongly advised not to leave cash, jewellery, valuables, or other items of value unattended in the hotel room or in a vehicle parked at the Hotel. Should the guest nevertheless do so, the Hotel accepts no liability in the event that the guest's cash, jewellery, valuables, or other items of value are stolen or otherwise lost.
VII. Entry to the Hotel Room by Hotel Staff
Hotel staff may enter the room at reasonable times for agreed cleaning, to carry out necessary maintenance or repair work, or in the event of a reasonable suspicion of danger or a significant breach of contract. Except in an emergency, appropriate regard will be given to the guest's privacy.
VIII. Overnight Prices and Other Prices
- The overnight rate to be paid by the guest is the consideration for the hotel making the hotel room available within the arrival and departure times set out in Section IV. A full overnight rate is charged per night – regardless of the guest's actual use or stay.
- The agreed prices, or the prices listed in the Hotel's price list valid at the time the contract is concluded, shall apply. Following conclusion of the contract, a change to the agreed price is only permissible if the guest subsequently wishes to change the booked services or length of stay and the Hotel agrees to this. If statutory taxes or public charges are newly introduced or amended after conclusion of the contract, such changes may be taken into account to the extent permitted by law.
- The prices or amounts stated in these Terms and in the accommodation contract each include the applicable value-added tax, unless expressly stated otherwise.
IX. Terms of Payment
- The overnight prices and the prices for additional services are due for payment in advance, at the latest upon the guest's arrival at the Hotel, regardless of the date of invoicing. If the guest's length of stay is indefinite, the overnight price and the prices for additional services shall be due for payment in advance for the following night by 11:00 am each day. If the guest fails to make a due advance payment or provide security despite being granted a reasonable grace period, the Hotel is entitled to withdraw from the contract or to terminate the contract for good cause. Further statutory rights remain unaffected.
- Notwithstanding item 1., the hotel is entitled to request in advance, i.e. at the time of reservation, an advance payment on the accommodation costs up to the amount of the expected total invoice or a reasonable security from the guest in the form of a deposited credit card number.
- Claims for additional services within the meaning of item 1. are, for example, parking fees, breakfast prices, fees for bringing pets, as well as all other claims that are not expressly stated in the accommodation contract as part of the overnight price.
- Exceptions to advance payment may only be approved by the hotel's reception staff. This may be the case, for example, if a credit card is provided, if costs are covered by a third party, or in the case of regular guests of the hotel.
- The hotel accepts cash in euros, bank transfers, girocard, as well as the debit and credit cards indicated at the hotel. Other means of payment are only permitted in exceptional cases and only with the hotel's consent.
- The guest may only assert rights of set-off or retention if the underlying counterclaims are undisputed or have been legally established.
X. Claims for Defects
If the hotel is unable to provide its services due to an event of force majeure for which it is not responsible, the statutory provisions shall apply. Amounts already paid for services not rendered will be refunded. Claims for damages exist only insofar as the hotel is responsible for the impediment to performance.
XI. Liability of the Hotel
- The contractual and statutory liability of the hotel is limited as follows:
- The hotel's liability is limited in amount to the damage typically foreseeable at the time the contract was concluded, for slightly negligent breach of material obligations under the accommodation contract.
- The hotel is not liable for slightly negligent breach of non-material obligations under the accommodation contract, nor for slight negligence in other respects.
Material obligations under the accommodation contract within the above meaning are those obligations which the hotel must fulfil towards the guest according to the content and purpose of the accommodation contract, the fulfilment of which makes the proper performance of the accommodation contract possible in the first place, and on whose observance the guest regularly relies and may rely.
The aforementioned limitation of liability does not apply in cases of mandatory statutory liability, in particular under the Product Liability Act, in the case of culpably caused injury to life, body or health, or in the case of loss, destruction or damage to items brought in by the guest. In these cases, the hotel's liability shall be governed by the statutory provisions.
- The hotel's strict liability for defects existing at the time the contract was concluded is excluded.
- The hotel is not responsible for delays in making the hotel room available due to force majeure or due to events that make it not merely temporarily but significantly more difficult or impossible for the hotel to provide the hotel room - this includes, in particular, strikes, lockouts and official orders - even in the case of guaranteed reservations. These entitle the hotel to postpone the provision of the hotel room for the duration of the impediment plus a reasonable lead time. If the delay on the day of arrival continues beyond 6:00 pm, the guest is entitled to withdraw from the accommodation contract. Claims for damages by the customer are excluded in this case.
XII. Duty to Report
In the event of theft or damage to their belongings, as well as in the event of a fire, water damage or any other damage in the hotel room, the guest must inform the hotel staff immediately and do everything that may be helpful in clarifying the theft or eliminating the damage.
XIII. Termination of the Accommodation Contract
- The hotel is entitled to withdraw from the accommodation contract if the guest fails to make the advance payment and/or the security owed in a timely manner or in full.
- The guest may terminate the accommodation contract at any time during the stay, at the latest by 6:00 pm, with effect from 11:00 am on the following day.
- Either contracting party may terminate the accommodation contract without notice for good cause. In particular, the hotel is entitled to terminate the accommodation contract without notice for good cause if the guest is under the influence of drugs during their stay at the hotel, uses the hotel room for prostitution, insults hotel staff or other hotel guests, disturbs the peace of other hotel guests, has previously made fictitious reservations, and/or wilfully destroys or damages the hotel inventory or room furnishings. This includes, in particular, smoking in a non-smoking room.
XIV. Data Protection
- The guest is advised that personal data will be stored and processed by the hotel for the purposes of contract performance, customer care and the hotel's own promotional activities, in compliance with the Federal Data Protection Act, and transmitted to companies affiliated with the hotel as well as selected third-party service providers. The hotel is entitled to make use of affiliated companies and selected third-party service providers to the extent necessary for carrying out data processing, and to forward personal data in accordance with this section to these companies and have it stored and processed by them.
- The guest is entitled to object at any time to the use of personal data for advertising purposes. Furthermore, the guest's rights to information, correction, blocking or deletion of their personal data stored by the hotel remain unaffected.
- Insofar as no statutory provisions dictate otherwise, the guest's personal data will be deleted after the accommodation contract ends and the statutory retention periods have expired.
XV. General Provisions
- In the event of contradictions between the accommodation contract and these General Terms and Conditions, the provisions of the accommodation contract shall take precedence.
- The accommodation contract and these General Terms and Conditions contain all agreements between the parties regarding the subject matter of the contract. There are no oral side agreements to the accommodation contract. Amendments or additions must be made in writing.
- All declarations and notifications to be made under the accommodation contract and these General Terms and Conditions must be made in writing, unless expressly stated otherwise.
- The hotel is entitled to transfer any rights or claims arising from the accommodation contract to third parties. Any assignment of rights or claims arising from the accommodation contract by the guest requires the hotel's prior written consent.
- The hotel is entitled to have obligations arising from and in connection with the accommodation contract performed by third parties.
- Any invalidity of one or more of the foregoing provisions does not affect the validity of the remaining provisions. The invalid provision is to be replaced by a valid one that comes closest to what the parties economically and legally intended.
- The accommodation contract is governed by the law of the Federal Republic of Germany, with the exception of the UN Convention on the International Sale of Goods.
- If the guest is a merchant and the accommodation contract is attributable to the operation of their commercial business, the hotel may sue this guest at the court responsible for the hotel's registered office or at any other competent court. The hotel itself may only be sued by the guest at the court responsible for the hotel's registered office. This choice of jurisdiction also applies to guests who carry out a comparable commercial activity abroad.
XVI. Special Conditions for Group Travel
- The following term "travel group" refers to a group of guests who together occupy at least 10 rooms. In deviation from, or in addition to, the above provisions, the following applies to a travel group:
- The travel group will designate a contact person (the "overall coordinator") for the hotel.
- Before the travel group's arrival, a list of names of all participants must be submitted to the hotel.
- Upon reservation, the overall coordinator will receive from the hotel a reservation or booking confirmation with the essential details of the reservation or booking made, information on check-in, and, if applicable, information on the security deposit and other terms of payment. Group reservations are always and automatically guaranteed reservations within the meaning of item III.1.
- The travel group must pay 50% of the accommodation costs by bank transfer to the hotel's bank account specified in the reservation or booking confirmation, or the account notified by the hotel to the person in overall charge after the reservation has been completed. The remaining amount is due in full upon arrival at the hotel. The travel group must reimburse the hotel in full for any fees for international transfers no later than upon arrival at the hotel.
- The travel group's deposit, including costs for ancillary services within the meaning of Section IX. 3., is due for payment in advance, no later than four weeks before the day of arrival, or, if the reservation is made less than four weeks before the day of arrival, immediately, in each case regardless of the invoice date. If the travel group or the respective guest does not pay the accommodation costs by no later than four weeks before the day of arrival, the hotel reserves the right, in the case of a credit card number provided, to charge the credit card for the amount of accommodation costs owed. If no payment has been made by four weeks before arrival, or if the card provided cannot be charged, the hotel is entitled to let the hotel room reserved for the travel group or the respective guest to other parties (without prior notice to the customer), without the guest being able to derive any claims against the hotel as a result.
- The travel group may cancel or change its reservation free of charge up to four weeks before the day of arrival. Later cancellations and changes are only possible in exceptional cases and only with the hotel's consent, and generally only upon payment of a cancellation fee.
- The hotel provides the travel group with its hotel rooms in the agreed room category and/or fittings on the day of arrival, subject to availability, generally from 2:00 pm, but in no case later than 3:00 pm.
- Upon the travel group's arrival at the hotel, the hotel is entitled to request a security deposit of up to € 500.00 per travel group from the group leader.
- The travel group will receive collective invoices from the hotel, which will be handed over to the overall coordinator.
XVII. Special Conditions for Trade Fair and Event Periods
- The hotel will inform the guest of trade fair and event periods at any time upon request, and at the latest at the time of booking or reservation. In deviation from, or in addition to, the above provisions, the following applies to trade fair and event periods:
- For overnight stays, only guaranteed reservations are possible. Simple reservations are not possible.
- The payment terms of clause XVI. 6. apply accordingly. For cancellations as well as changes to the length of stay, room category or number of rooms, clause XVI. 7. applies accordingly.
